Illustration Terms of Use

These Terms of Use (hereinafter referred to as "the Terms") set forth the conditions for using the illustration materials (hereinafter referred to as "the Illustrations") provided on the website operated by KOGERA Culture & Develop (hereinafter referred to as "the Brand"). All persons who use this site (hereinafter referred to as "Users") are deemed to have agreed to these Terms.

Article 1 (Application and Changes to the Terms)

1. These Terms apply to all actions related to the use of this site. By using this site, Users agree to comply with the contents of these Terms.
2. The Brand may revise the contents of these Terms as necessary.
3. When the Terms are revised, notification will be given in advance by posting on this site. The revised Terms will become effective from the time they are posted on this site. If a User continues to use this site after the changes, they are deemed to have agreed to the revised Terms.

Article 2 (License and Conditions of Use)

Users may use the purchased Illustrations under the following conditions:

1. The Illustrations may be used free of charge for both personal and commercial purposes (e.g., websites, blogs, presentation materials, printed matter).
2. Users may modify the Illustrations for use.
3. No attribution or credit is required.

Article 3 (Intellectual Property Rights)

All intellectual property rights, including copyrights, for the Illustrations provided on this site belong to the Brand or legitimate right holders. The copyright is not transferred to the User by downloading or using the Illustrations.

Article 4 (Prohibited Matters)

Users must not engage in the following acts when using this site:

1. Acts that violate laws or public order and morals.
2. Redistributing, selling, lending, or transferring the Illustrations themselves or modified versions thereof.
3. Using the Illustrations as the main content of a product for sale (e.g., T-shirts, mugs, digital content).
4. Acts that infringe on the intellectual property rights, portrait rights, privacy rights, etc., of the Brand or third parties.
5. Using the Illustrations for the purpose of slandering or defaming specific organizations or individuals.
6. Using the Illustrations in a way that significantly harms their original image.
7. Granting a sublicense to a third party to use the Illustrations.
8. Directly linking to the download URLs of the Illustrations.
9. Any other acts that the Brand deems inappropriate.

Article 5 (Exclusion of Anti-Social Forces)

1. Users represent and warrant that they are not and will not in the future be an anti-social force (e.g., a gang, gang member, person for whom five years have not passed since ceasing to be a gang member, quasi-gang member, gang-affiliated company, corporate racketeer, or any other similar person).
2. If the Brand determines that a User is an anti-social force, the Brand may terminate the contract with the User and prohibit the use of the Illustrations without prior notice.

Article 6 (Disclaimers)

1. The Brand does not guarantee that the Illustrations are perfect, accurate, or suitable for the User's specific purpose.
2. The Brand is not responsible for any troubles or damages incurred by the User from the use of this site or the Illustrations.
3. The Brand may interrupt or terminate the provision of services without notice and is not responsible for any damages caused thereby.

Article 7 (Measures for Violation of Terms)

If a User violates these Terms, the Brand may suspend the User's use or terminate the contract without prior notice. The Brand is not responsible for any damages incurred by the User as a result of such measures.

Article 8 (Handling of Personal Information)

The Brand will appropriately handle personal information obtained through the provision of this service in accordance with our Privacy Policy.

Article 9 (Governing Law and Jurisdiction)

The interpretation of these Terms shall be governed by the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

イラスト利用規約

本利用規約（以下「本規約」といいます）は、KOGERA Culture & Develop（以下「本ブランド」といいます）が運営するサイトで提供されるイラスト素材（以下「本イラスト」といいます）の利用条件を定めるものです。本サイトを利用するすべての方（以下「利用者」といいます）は、本規約に同意したものとみなされます。

第1条（適用および規約の変更）

1. 本規約は、本サイトの利用に関わる一切の行為に適用されます。利用者は、本サイトを利用するにあたり、本規約の内容に従うものとします。
2. 本ブランドは、本規約の内容を必要に応じて改定できるものとします。
3. 本規約を改定する場合は、事前に本サイト上での掲示により通知します。改定後の規約は、本サイト上に掲示された時点より効力を生じ、利用者が変更後も本サイトを利用した時点で、変更後の規約に同意したものとみなします。

第2条（ライセンス・利用条件）

利用者は、購入した本イラストを以下の条件に基づき利用できます。

1. 個人利用、商用利用を問わず、無償で利用できます（例：ウェブサイト、ブログ、プレゼンテーション資料、印刷物など）。
2. 利用者は、本イラストを改変して利用することができます。
3. クレジット表記や利用報告は不要です。

第3条（知的財産権）

本サイトで提供される本イラストに関する著作権等の知的財産権は、すべて本ブランドまたは正当な権利者に帰属します。利用者は、本イラストをダウンロードまたは使用した時点で、著作権が利用者に移転するものではないことを認識し、同意するものとします。

第4条（禁止事項）

利用者は、本サイトの利用にあたり、以下の行為を行ってはなりません。

1. 法令または公序良俗に違反する行為
2. 本イラストそのもの、または改変したものを再配布、販売、貸与、譲渡する行為
3. 本イラストを主たるコンテンツとして製品（Tシャツ、マグカップ、デジタルコンテンツ等）を制作し、販売する行為
4. 本ブランドまたは第三者の知的財産権、肖像権、プライバシー権等を侵害する行為
5. 本イラストを用いて特定の組織や個人を誹謗中傷する行為
6. 本イラストが持つ本来のイメージを著しく損なうような利用
7. 第三者に対し、本イラストの利用を許諾（サブライセンス）すること
8. 本イラストのダウンロードURLへの直接リンク
9. その他、本ブランドが不適切と判断する行為

第5条（反社会的勢力の排除）

1. 利用者は、現在および将来にわたり、暴力団、暴力団員、暴力団員でなくなったときから5年を経過しない者、暴力団準構成員、暴力団関係企業、総会屋等、社会運動等標ぼうゴロまたは特殊知能暴力集団その他これらに準ずる者（以下「反社会的勢力」といいます）ではないことを表明し保証します。
2. 本ブランドが利用者を反社会的勢力に該当すると判断した場合、本ブランドは事前の通知なく当該利用者との契約を解除し、本イラストの利用を禁止します。

第6条（免責事項）

1. 本ブランドは、本イラストが完全、正確であること、または利用者の特定の目的に適合することを保証するものではありません。
2. 本サイトまたは本イラストの利用により発生したトラブルや損害について、本ブランドは一切の責任を負いません。
3. 本ブランドは、予告なくサービスの提供を中断または終了する可能性があり、それによって生じた損害に責任を負いません。

第7条（利用規約違反時の措置）

利用者が本規約に違反した場合、本ブランドは事前の通知なく当該利用者の利用を停止または契約を解除することができます。上記によって利用者に損害が発生した場合でも、本ブランドは責任を負いません。

第8条（個人情報の取扱い）

本ブランドは、本サービスの提供にあたり取得した個人情報を、別途定めるプライバシーポリシーに基づき適切に取り扱います。

第9条（準拠法・管轄裁判所）

本規約の解釈には、日本法を準拠法とします。本規約に関連して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
